The Principal Broker will execute brokerage operations and ensure that all company policies, procedures, and practices follow applicable state and federal laws, rules and regulations and represent best business practices, as they relate to real estate regulatory mandates.

A Principal Broker in Hawaii, when conducting business in Hawaii, is required hold a current Hawaii Active Broker's License. Pre-approved fees for required real estate courses for continuing education would be reimbursed by the Company, subject to the prior approval of the Company. The duties and responsibilities of Principal Broker include, but are not limited to, the following:

  • You will at all times maintain your real estate broker's license in good standing with the Real Estate Commission, Department of Commerce and Consumer Affairs, of the State of Hawaii. If at any time during the term of your employment, any complaints are filed with the Real Estate Commission against you as a real estate licensee or any disciplinary action is instituted against you including, but not limited to, suspension or revocation of your real estate broker's license, you will immediately notify the Company of such complaints or action. Failure to maintain, your real estate broker's license from the State of Hawaii in good standing wilt constitute grounds to terminate your employment.
  • You will be responsible for and will perform the filing of the real estate broker’s license application for the Company and for filing any renewals thereof. You will verify the completeness of the application and oversee the submission of appropriate fees and the delivery of all necessary documents to the Real Estate Commission by the required applicable deadlines.
  • You will perform site visits at all properties managed by the Company (or its affiliates) in Hawaii or for which the Company provides rental services (or any other properties in Hawaii where the Company provides rental services out of, if requested by the Company) at least one time each year, or more frequently if requested by the Company, to review the management and/or rental operations at such properties and report observations and concerns to your supervisor.
  • You will perform and fulfill the statutorily required duties of a principal broker as set forth in Section 467-1.6. Hawaii Revised Statutes ("HRS"), the same may be amended from time to time. Section 467-1.6, HRS, currently provides as
  • (a) The principal broker shall have direct management and supervision of the brokerage firm and its real estate licensees.
  • (b) The principal broker shall be responsible for:
  • (l) The client trust accounts; disbursements from those accounts, and the brokerage firm’s accounting practices;
  • (2) The brokerage firm’s records, contracts and documents;
  • (3) All real estate contracts of the brokerage firm and its handling by the approved real estate salesperson;
  • (4) The proper handling of any commission application, real estate license application, or renewal application that the principal broker or the brokerage firm expressly agrees to handle on behalf of the applicant, including without limitation, verifying for completeness and appropriate fees, and mailing or delivering the appropriate documents to the commission by the required deadline;
  • (5) Developing policies and procedures for the brokerage firm concerning the handling of real estate transactions and the conduct of the associated real estate licensees and other staff, including education and enforcement of the policies and procedures;
  • (6) Setting a policy on continuing education requirements for all associated real estate licensees in compliance with the statutory requirement;
  • (7) Ensuring that the licenses of all associated real estate licensees and the brokerage firm license are current and active;
  • (8) Establishing and maintaining a training program for all associated real estate licensees; and
  • (9) Ensuring that all associated real estate licensees are provided information and training on the latest amendments to real estate licensing laws and rules as well as other related laws and rules.
  • The principal broker may delegate management and supervision duties to one or more brokers in charge subject to the principal broker's written policies and procedures. The principal broker shall be responsible for the education, enforcement, and records required of such policies and procedures.
  • You will devote sufficient time, attention, and energy to fulfill the above-described duties for the Company. During the term of your employment with the Company, other than performing the duties and responsibilities set forth in this letter as Principal Broker, you will not engage in any other real estate activity as a real estate broker or licensee, whether or not during normal business hours and whether such activity is pursued for gain, profit or other pecuniary advantage.
