JOB SUMMARY

Responsible for managing the regulatory requirements to ensure compliance with Australian laws with regards to the Australian Financial Services License (AFSL) and managed investment scheme regimes. Also responsible for developing and maintaining specific company policies and processes to ensure compliance with such policies, as well as conducting the required compliance reviews as required by Australian regulations. The Compliance Officer serves as the Company Liaison on the Compliance Committee, preparing the quarterly Compliance Officer's report and reporting the quarterly results, The Compliance officer also closely monitors the internal and external dispute resolution processes, ensuring the Company meets it's regulatory requirements, In addition to monitoring compliance with the AFSL, the Compliance Officer will also review compliance with the Australian Credit License (ACL), working closely with the Responsible Manager.

CANDIDATE PROFILE

Education and Experience

  • Degree from an accredited university in Finance & Accounting, Business Administration, or related major.
  • A minimum of 6 years of experience as a compliance professional ideally within the Australian vacation ownership industry.
  • Accounting, finance or legal background preferable.

COMPLIANCE OFFICER RESPONSIBILITIES

  • Maintains the compliance program of the time-sharing managed investment scheme ("Scheme) in Australia.
  • Works with the business to ensure awareness of the compliance program.
  • Assists in regular compliance monitoring, surveillance, audit, and reporting activities.
  • Maintains a range of Legal & Compliance Registers & Databases.
  • Assists with compliance reviews and audits.
  • Assists in administration of existing policies and procedures in a range of areas, including corporate governance, complaints and risk management.
  • Prepares and undertakes all legal and regulatory lodgments and other filings as required
  • Acts as a liaison with and assists in the provision of documents to internal and external auditors and the Australian Securities and Investments Commission.
  • Reviews regulatory changes with the Legal team and assists with implementation within the Scheme.
  • Manages compliance with Scheme's Australian Financial Services License.
  • Advises business leaders in relation to regulatory requirements of a Scheme and an Australian Financial Services License.
  • Reports breaches and monitors rectification.
  • Prepares compliance reporting to the Compliance Committee, Responsible Managers and Board of Directors.
  • Assists in the review of marketing material and monitoring of license conditions.
  • Maintains awareness of and manages compliance issues.
  • Trains associates on compliance requirements, arrange external training (where required), and maintain training registers.
  • Monitors internal and external dispute resolution activities to ensure compliance with regulations.
  • Acts as a liaison with the Australian Financial Complaints Authority (AFCA) to resolve external disputes.
  • Acts as a liaison with the Australian Timeshare Ownership Council (ATHOC).
  • Perform monitoring activity regarding compliance with regulatory requirements of the ACL.
  • Facilitates the update of the Product Disclosure Statement and the Compliance Plan annually, at a minimum,

  • Coordinates and implements work and projects as assigned.
  • Coordinates, implements, and follows up on audits for all areas of business operations.
  • Complies with governmental laws applying to operations procedures.

  • Compiles, codes, categorizes, calculates, tabulates, audits, or verifies information or data.

Supporting Property Operations

  • Works with sales operations teams to develop an operational strategy that is aligned with the brand's business strategy.
  • Reviews comment cards, guest satisfaction results and other data to identify areas of improvement.
  • Reviews findings from comment cards and guest satisfaction results with leadership team and ensures appropriate corrective action is taken.
  • Works with team to put sustainable work processes and systems in place that support the execution of the strategy.
  • Communicates a clear and consistent message regarding departmental goals to produce desired results.

Managing and Monitoring Activities that Affect the Customer and Guest Experience

  • Provides excellent customer service by being readily available/approachable for all customers and guests.
  • Takes proactive approaches when dealing with customers and guest concerns.
  • Extends professionalism and courtesy to customers and guests at all times.

  • Ensures all team members meet or exceed all regulatory requirements.
